Terms of Service

1. Eligibility and accounts

1.1 You must be at least 18 years old, or the age of legal majority where you live, to use the Service.

1.2 You must provide accurate information when you create an account and keep it up to date.

1.3 You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly at hello@pimpmyviews.com if you suspect unauthorised use.

1.4 Accounts are for one person unless your plan includes additional seats. You must not share your login or let others use your account.

1.5 If you use the Service on behalf of a business, you confirm you are authorised to accept these Terms on its behalf.

2. The Service

2.1 PimpMyViews helps creators research YouTube content, including identifying outlier videos, tracking channels, organising ideas, and generating AI-assisted title, hook and thumbnail feedback.

2.2 We may add, change or remove features over time. If we remove a core feature of a paid plan, we will give reasonable notice where practical.

2.3 The Service relies on third-party services, including YouTube API Services, AI providers and payment processors. We are not responsible for their availability, accuracy or changes, and some features may be limited or unavailable if a third party restricts access.

3. YouTube API Services

3.1 The Service uses YouTube API Services. By using the Service, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms).

3.2 Google's handling of data is described in the Google Privacy Policy (https://policies.google.com/privacy).

3.3 YouTube data shown in the Service (such as views, subscriber counts, titles and thumbnails) is provided by YouTube, may be cached for a limited period, and may not be complete or current.

3.4 PimpMyViews is not affiliated with, endorsed or sponsored by YouTube or Google. "YouTube" is a trademark of Google LLC.

4. Plans, usage limits and fair use

4.1 We offer a free plan and paid plans. Features and usage limits for each plan (such as searches, thumbnail critiques and title and hook generations) are described on our Pricing page, which forms part of these Terms.

4.2 Usage limits reset daily or monthly as shown in the Service. Unused allowances do not roll over.

4.3 To protect the Service for all users, we may apply rate limits, temporarily pause features during periods of high demand, or serve recently cached results.

4.4 If your use is excessive, automated or harms the Service or other users, we may limit or suspend your access, whether or not you have reached your plan's stated limits.

5. Acceptable use

You must not, and must not allow others to:

1. (a)scrape, crawl, harvest or bulk-download data from the Service, or access it by any automated means other than features we provide;
2. (b)resell, sublicense, rent or commercially redistribute the Service or its data, or use it to build a competing product;
3. (c)share, sell or transfer your account or access;
4. (d)circumvent or attempt to circumvent usage limits, payment, security or access controls;
5. (e)reverse engineer, decompile or copy the Service, except where the law allows;
6. (f)upload content you do not have the right to use, or content that is unlawful, infringing, harmful, sexually explicit or abusive;
7. (g)use the Service to violate the YouTube Terms of Service, YouTube's policies, or any law, or to manipulate views, engagement or metrics;
8. (h)interfere with or disrupt the Service, its servers or other users, including by introducing malware; or
9. (i)use the Service in any way that is misleading, fraudulent or harmful.

6. Billing, trials and auto-renewal

6.1 Paid plans are billed in advance, monthly or annually, in US dollars, through our payment processor, Stripe. Prices are shown on the Pricing page and may include or exclude taxes depending on your location.

6.2 Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, until you cancel. You authorise us to charge your payment method for each renewal.

6.3 Free trials: the Creator plan includes a 7-day free trial. A payment card is required. You will be charged when the trial ends unless you cancel before then. Trials are limited to one per customer.

6.4 Founding member pricing and promotional prices apply only as described in the offer and while your subscription remains active. If you cancel, the promotional price may not be available again.

6.5 Plan changes: upgrades take effect immediately and are prorated. Downgrades, including switching from annual to monthly billing, take effect at the next renewal.

6.6 If a payment fails, we may retry the charge and may limit or downgrade your account until payment succeeds.

6.7 We may change prices with at least 30 days' notice by email. Changes apply from your next renewal after the notice period. If you do not agree, you can cancel before the change takes effect.

7. Cancellation and refunds

7.1 You can cancel at any time from your Billing page. Cancellation takes effect at the end of your current billing period, and you keep access to paid features until then. See our Refund & Cancellation Policy for full details.

7.2 Money-back guarantee: if you are not satisfied, contact us at hello@pimpmyviews.com within 14 days of your first payment for a plan and we will refund that payment in full. No questions asked.

7.3 Outside that 14-day window, payments are non-refundable and we do not provide refunds or credits for partial billing periods or unused allowances, except where required by law.

7.4 We may suspend or close your account if you materially breach these Terms, if required by law, or if needed to protect the Service or other users. Where the closure is not due to your breach, we will refund any prepaid fees for the unused period.

8. Your content

8.1 You keep ownership of content you upload or create in the Service, such as thumbnails, notes and boards ("Your Content").

8.2 You grant us a limited licence to host, process and display Your Content only as needed to provide and improve the Service, including sending it to our AI and infrastructure providers for processing.

8.3 If you make a board public, anyone with the link can view it. Do not include information in public boards that you want to keep private.

8.4 You are responsible for Your Content and confirm that you have the rights needed to upload it.

9. AI-generated output

9.1 Some features use artificial intelligence to generate titles, hooks, scores and critiques ("Output"). Output is generated automatically, may be inaccurate or similar to output given to other users, and is provided as suggestions only.

9.2 You are responsible for reviewing Output before using it, including checking that it does not infringe anyone else's rights. As between you and us, you may use Output for your own content.

9.3 Scores, outlier ratings and predictions are estimates. We do not guarantee any views, subscribers, revenue or other results.

10. Our intellectual property

The Service, including its software, design, branding and content (excluding Your Content and third-party data), is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own content research and creation, subject to these Terms. You may send us feedback, and we may use it without obligation to you.

11. Privacy

Our handling of personal information is described in our Privacy Policy. By using the Service, you acknowledge that your information will be handled as described there.

12. Disclaimers

12.1 The Service is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that it will be uninterrupted, error-free, or that data or Output will be accurate, complete or current.

12.2 Nothing in the Service is professional, financial or legal advice.

13. Consumer guarantees

If you are a consumer under the Australian Consumer Law, or under the consumer laws of your country, you have rights that cannot be excluded, restricted or modified. Nothing in these Terms excludes those rights. Where our liability for failing to comply with a consumer guarantee can lawfully be limited, it is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

14. Limitation of liability

14.1 To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data, views, subscribers or business opportunity, arising from or relating to the Service.

14.2 To the maximum extent permitted by law, our total liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, and (b) US$100.

14.3 These limits do not apply to liability that cannot be limited by law.

15. Indemnity

To the extent permitted by law, you agree to indemnify us against claims, losses and costs (including reasonable legal costs) arising from your breach of these Terms, Your Content, or your misuse of the Service, except to the extent caused by our own fault.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in the Service at least 14 days before they take effect. Continuing to use the Service after the changes take effect means you accept them. If you do not agree, you may cancel your subscription.

17. Governing law and disputes

17.1 These Terms are governed by the laws of [STATE], Australia.

17.2 Before starting formal proceedings, please contact us at hello@pimpmyviews.com so we can try to resolve the issue informally.

17.3 Each party submits to the non-exclusive jurisdiction of the courts of [STATE], Australia, and the courts entitled to hear appeals from them. This does not prevent you from relying on consumer protection laws in your own country.

18. General

18.1 These Terms, together with our Privacy Policy and Pricing page, form the entire agreement between you and us about the Service.

18.2 If any part of these Terms is found unenforceable, the rest remains in effect.

18.3 If we do not enforce a right, we do not waive it.

18.4 You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a sale or restructure of the business, with notice to you.
